Why “Maintained Status” is Your Only Defense

If you have submitted your application for permanent residence (PR) but your current work permit—whether it is a PGWP or an employer-specific permit—is nearing its expiration, you are not just facing a deadline. You are facing a litigation risk.

  • The Trigger: You cannot apply for a BOWP simply because you have an Invitation to Apply (ITA). You generally must have already submitted your full PR application and received your Acknowledgement of Receipt (AOR).

  • The AOR Catch: If your work permit expires before you have that AOR, your eligibility for a BOWP evaporates. This is where most applicants fail the audit.


Maintained Status: The “Stop” vs. “Continue” Threshold

The difference between a seamless transition and a catastrophic loss of work eligibility lies in a single regulatory concept: Maintained Status.

  • The “Stop” Scenario: If your work permit expires before you have submitted a valid application for a new permit, you are effectively out of status. You must cease working immediately. Any work performed after this point is unauthorized, which can jeopardize your entire PR application under Section 40 (Misrepresentation).

  • The “Maintain” Scenario: If you apply for a new work permit (like a BOWP) before your current permit expires, you are legally permitted to continue working under the same conditions while IRCC processes your request.

This is not a “grace period.” It is a statutory right that requires perfect timing and perfect application filing.
